WEDDING PHOTOGRAPHY AGREEMENT
Terms & Conditions
Payment Policy | Our standard payment schedule starts with a non-refundable 25% retainer due with the contract to secure your date and reserve Studio EMP as your photographer. Half of the balance is due two months prior to the wedding date and the final balance is due two weeks before the wedding. We may accommodate alternative payment policies aside from the retainer- just ask!
Cancellation Policy | In the event Client cancels this contract the retainer is non-refundable. If the client cancels the event date Client will lose their retainer. All cancellations must be made in writing, signed by the contracted party, and sent via Certified Mail by the United States Post Office to ensure delivery.
If, however, Studio EMP is unable to perform pursuant to the terms of this contract due to negligence, illness, accident, fire, road closures, severe traffic or any other avoidable or unavoidable action, Studio EMP may offer a replacement photographer(s). The Client may, but has no obligation to, consent to using the replacement. If the Client does not accept the replacement the deposit shall be refunded in the form of a certified check to the Client. Studio EMP will not be liable for any damages or unsatisfactory services provided by the substitute photographer. Note: this has never happened in Studio EMP’s 15 years and hundreds of weddings.
Day of Wedding Photography Schedule | The photography schedule and selected methodology are designed to accomplish the goals and wishes of the Clients in a manner enjoyed by all parties. Clients and photographer agree that the cheerful cooperation and punctuality are therefore essential to that purpose. Shooting commences at the scheduled start time. The photographer is not liable for requested photos not taken due to a delayed start. The photographer will try to meet and exceed the client’s expectations but is not liable for any unforeseen circumstances that may affect the photographer’s ability to capture all photos on the clients requested list.
Timeline | Studio EMP kindly asks that the client to provide a timeline of the event and contact Studio EMP two weeks prior to the date of your event to go over last minute details or changes in the schedule.
Photography Requests | Client is encouraged to provide a list of requests as long as the client is aware that no photographs are guaranteed. This includes but is not limited to specific poses, specific subjects, and details. Lists provided by the Client will act as an organizational tool only. Studio EMP appreciates a requested list of five to ten photos and can include names of guests or specific times during the wedding. Studio EMP will do their best to capture all requested images along with many others but due to the nature of weddings, no specific photographs can be guaranteed as there are many factors that can affect the ability of a photographer to capture every desired shot.
The Client understands that weddings are dynamic, fast moving and are an uncontrolled event. It is the client’s responsibility to see that all persons to be documented are available, on time and cooperative. Wedding guests may take photos or video, but it is the responsibility of the client to prevent guest from interfering with documentation duties- Studio EMP will NOT demand your guests to move to get out our way. Studio EMP is not responsible for compromised coverage due to causes beyond our control such as, interference of individuals such as wedding guests, vendors, or the public, other people's camera or flash, weather conditions, equipment failure, schedule complications, rendering of decorations, existing backgrounds or lighting conditions, which may negatively impact or restrict the photography coverage. Available light and natural light will be used as long as possible but flashes will be used after dusk or in dimly lit situations.
Officiant and Venue Restrictions | Studio EMP photographers may be limited by the guidelines or rules of the ceremony official, ceremony venue, or reception venue. Client understands and agrees that Studio EMP will abide by such guidelines or rules and that they are outside the control of Studio EMP. Client agrees to hold Studio EMP harmless for the impact such guidelines or rules may have on the finished product.
Event Coordinator | It is appreciated that the event coordinator informs Studio EMP of any changes in the schedule the day of the wedding. The coordinator must observe all of the client’s responsibilities as stated in this contract. Studio EMP is not liable for the actions of the coordinator.
Model Release | Studio EMP has permission to get prints and DVDs made after the images have been created and edited. These images will be used for self- promotion only. This can include DVDs, promo pieces, website use or any advertisement. The client will be notified if used in any magazine ad. If the Client wishes to not have their images used for self promotion this must be stated prior to the signing of the contract.
Copyrights | All photographs taken by Studio EMP is his property, will remain his property and are protected by United States Copyright Laws (USC Title 17). Client hereby waives any claims for ownership, income, editorial control and use of the photos. As the owner of these images, Studio EMP may grant private usage rights to the Client if agreed upon.
Creative License/Artistic View | Studio EMP has full creative control on framing and cropping of photographs. The decision as to how the images get processed will be based on the discretion of Studio EMP unless specified 6 weeks prior to the wedding date in writing. The photographs are edited at the photographers discretion, and delivered DVD may not include all photographs. The photographer reserves the creative right to edit and release only those within the photographer’s artistic standards.
Shipping | All products will incur a $50 shipping fee. Packages will be shipped with a confirmed signature and insurance. Studio EMP is not responsible for lost, stolen, destroyed or damaged packages for reasons beyond or within our control.
Liability | Owner Joel Maus’ liability for any claim, breach or damage shall be limited to repayment of sums paid by client only. It shall not be liable for any claims for emotional distress, consequential damages, loss of profit, loss of enjoyment, lost revenues, replacement costs, compensatory damages and/or punitive damages. No individual working with Studio EMP nor its employees, agents, contractors, shareholders, officers, directors, members or managers shall in any manner be personally liable for any acts or omissions and client hereby waives any rights to seek relief from any individual.
